92.) When an indigenous nation agrees to monetary land settlements, an "extinguishment clause" to void treaties, treaty land rights/land claims is a mandated part of that settlement. Everytime this is done, the United States and Canada are one step closer to assimilating indigenous people through legislated, administrative measures. (7 min. read)

 And those legislated, administrative measures are already in place.

In the United States, it is the administration of the Bureau of Indian Affairs that is assimilating these "tribal nations". This process has already started.

And in Canada, it is the "central administration" of the "Indian Act-elected band councils", also known as the Assembly of First Nations, that is assimilating these "first nations". This process has already started.

Both of these "administrations of assimilation", are currently masquerading as "governments" of the indigenous nations.

Again, this is why treaties do not belong in the courts. Treaties are to be dealt with nation to nation, at the negotiation table.

A major step in the assimilation process is the extinguishments of treaties. Chip by chip, piece by piece, treaties are lost to the court system this way. This has already been done with many indigenous nations across north america, through monetary land settlements and gaming compacts that include extinguishment clauses.

The sovereignty of an indigenous nation rests on their "treaties and the treaty land rights/land of stolen land". When an indigenous nation accepts monetary land claim settlements, with extinguishment of their treaties, they weaken their sovereignty. These indigenous nations then legislatively become "tribal nations", and then can simply be administered out of existence. Thereby being fully assimilated into the ruling power.

End of the "Indian problem".

All of these treaty land rights/land claim settlements include an "extinguishment clause" to permanently end various sovereign treaty rights.

This also includes gaming compacts, for casinos. Every time an indigenous nation negotiates a gaming compact, they give up or extinguish, some of their indigenous rights. Some indigenous nations have agreed to give up their hunting and fishing rights, because they say their people no longer hunt or fish.

According to these "extinguishment agreements", treaties are voided and no longer exist. To legally change or extinguish a treaty, both parties must agree. (See article 46.) 

But these agreements are only between the U.S. government and itself.

And these agreements are only between the Canadian government and itself.

But the indigenous people of these indigenous nations do not have a say in the matter and do not know the details of these extinguishment agreements. So these extinguishment agreements are done in bad faith. They are not legal or enforceable, according to the United Nations Declaration on the Rights of Indigenous People (UNDRIP/BillC15).

Indigenous treaties are the basis for indigenous sovereignty. Once there are no more treaties, you only have left these "mechanisms of assimilation to the ruling power". Again, in the United States, that mechanism is the Bureau of Indian Affairs. In Canada, that mechanism is the "elected band councils of the Indian Act". Also known as the Assembly of First Nations.

And you can't even find out what "extinguishment agreements" the U.S. and Canadian governments are going to make or have already made, through their "mechanisms of assimilation". It is legislated that they don't have to give out any information to the people of an indigenous nation or anyone else. Not even when a court case with monetary settlements talks are in progress. These extinguishment clauses are kept secret between the U.S./Canadian governments and their "mechanisms of assimilation", while they illegally extinguish the sovereign lives of the indigenous people.

As expressed in previous articles, in the U.S., you can't even find out what extinguishment agreements the BIA has already made with the BIA controlled tribal nations. The BIA does not have to give out any information, as per the Freedom of Information Laws (FOIL). FOIL does not apply to the BIA, because the BIA claims it only deals with indians. 

And the two "tribal nations" in New York State that have "BIA Representatives" as their leaders, can negotiate any and all agreements with the BIA, including "extinguishment agreements", without notifying the indigenous people of that "tribal nation".

Again, it is really the U.S. government dealing with itself through the BIA. And the Canadian government dealing with itself through the Indian Act-elected band council/Assembly of First Nations

And the Haudenosaunee people have known for a long time, that the Haudenosaunee Confederacy is the only sovereign stopping the U.S. and Canadian governments from doing away with all the other indigenous nations across north america.

Haudenossunee treaties, treaty land rights/land claims to stolen land, are a form of protection against these governments from completely assimilating the Haudenosaunee people. World public opinion also prevents the assimilation of indigenous people. If these and other protections of the Haudenossunee people are removed piece by piece, it is only a matter of time before the "administrations of assimilation" will completely "extinguish" the Haudenosaunee people, forever.

This is the plan, and it's happening now.
