101.) The recent NYS Appeals court decision, ruling against the BIA-Cayuga tribal court, brings up a very important point about the collecting of evidence of "first hand" accounts of the Cayuga people and the non-indigenous people living around Cayuga Lake. (18 min. very important read)
Written evidence of how all have been negatively affected by the BIA-Cayuga Nation tribal court. And the absolute need to have written documentation of these negative experiences and events that were committed by the Cayuga nation tribal court, against the Cayuga people, their children and the non-indigenous people and their children.
All Haudenosaunee-Cayuga citizens and the non-indigenous people living around Cayuga Lake need to start writing down how the Bureau of Indian Affairs indian government, the Cayuga tribal court and the BIA Representative have negatively affected their lives. Past and present.
If you have not done this yet, you need to do this now. Write down and document as much "first hand" information and negitive experiences that you have had or are currently experiencing. And how it makes you feel.
Also collect any and all documentation that you have, including court documents, legal papers, photos, documents handed out by the BIA-Cayuga Nation government, tribal court and associates. If you don't have this information in your possession, find out where it is and get it. Start to put it all in one central location for yourself. Make sure it can be located immediately, when needed, Don't wait until it's needed, to start gathering this information for yourself. Everyone involved should start doing this now.
This writing down of the negative, first hand experiences and the gathering of documents is of primary importance, in revealing the heinous truth about the Cayuga tribal court.
Remember : You are the only source of this truth. You must have your only source of this truth immediately available, when it will be needed. Don't wait for the time when it is needed, and then you are hastily writing things down, searching and forgetting. You won't be able to remember everything all at once. This writing down of traumatic events will take time.
Your first hand accounts, experiences and documentation, are the only way to revel the heinous truth about the Cayuga Nation tribal court. There is no other way to reveal this heinous truth. There is only your first-hand accounts that you have witnessed, to do this. This is why it is so important that everyone involved start writing down their first hand accounts of what they have witnessed.
Remember "serious mental harm" is also a part of the United Nations definition of genocide. Most times, the United Nations only uses the charge of genocide when there are "mass killings". But "serious mental harm" is just as valid a charge of genocide as "mass killings". "Serious mental harm" and "serious physical harm" are part of the definition of Genocide.
So this gathering of information would also include mental health issues. Mental health issues can quickly develop into physical symptoms and maladies. No one likes to admit mental health issues due to the stigma surrounding.
But seeking out a mental health practitioner under these circumstances, is a sign of responsible behavior, for yourself and your children.
Seeking out mental health practitioners can be done in private. Even if you feel you aren't affected by this, you should still seek out a mental health practitioner to confirm your current state of mental health. And what about your children? Most adults cannot speak clinically for the mental health of a child. And only a mental health practitioners diagnosis, can be entered into evidence in a legal proceeding. This is true for adults and children.
The state of the mental health of the Cayuga people and the non-indigenous people living around Cayuga Lake is just as important as the traumatic physical events that occured due to the Cayuga tribal court.
And a caveat among mental health practitioners is "everyone is not a fit". This means that you may have to go through more than one practitioner, to find the one that's right for you. This is understood by all mental health practitioners.
Be aware that writing down the traumatic events that have occurred to you and your children, may bring back negative feelings about what has happened to you. Thinking about these events can cause you to experience all the negative feelings that occurred when these traumatic events happened to you. These feelings can bring on "post traumatic stress disorder" (PTSD) like symptoms. These thoughts may be what are called "triggers". It's like you are reliving those traumatic events all over again. If these negative feelings occurs, seek out a mental health practitioner as soon as possible.
The mental health aspect of what has happened to you by these traumatic events is just as important, and at times, more important than the physical traumatic events that occurred to you and your children.
Especially in legal proceedings. And remember there are two types of legal proceedings. Criminal and civil. Civil proceedings are for the recovery of monetary damages for physical and/or mental harm. And payment of damages may be awarded "punitively". Which means the individual who caused the harm will be solely responsible for payment of the court award, not the BIA indian government, the tribal court or municipality.
This short description can not be a substitute for seeking out a mental health practitioner.
All involved should contact a mental health practitioner to determine the current state of their mental health. It would be unrealistic to think that all that you have been through, has not affected your mental health. This may very well be denial. Again, think about the children.
Seeking out a practitioner of mental health is not saying that you have a mental health issue. It is saying that you are being a responsible adult not only to yourself, but to your children and the coming generations. How can that be considered a stigma?
Stop the stigma of getting the help that may be needed. You owe it to your children and the coming generations. The Creator cares for the children the most.
Think about the survivors of the Residential Schools and how they suffered for all those years, a lifetime, without seeking help. Not knowing what was happening to them. Not knowing all the while that they were normal. That they were having a normal reaction to an abnormal situation . That any normal person, would have reacted in exactly the same way they did, to the heinous Residential School experience. Think about how it negatively affected themselves, their family and friends and generations to come. Some call it "historical trauma". You cannot let this type of horrible experience happen all over again to your yourself, your children and the come generations. It is the BIA-Cayuga nation tribal court that is abnormal, not you.
Don't let the "Legacy of the BIA- Cayuga Nation Tribal Court", be yet another "Legacy of the Residential Schools". Do not let it cause mental health issues for generations to come. We must all work together to stop the continuation of "historical trauma".
These short comments should not be taken as a substitute for talking to a mental health practitioner. This is very important.
So start writing down your "first hand" negative experiences now. It doesn't have to be anything fancy. Just get a notepad and pen and start writing. You can start to organize the thoughts after.
What I do is get a writing pad and at the bottom of each page, put the subject matter. Then as time goes on, and I think of something on that subject, I go to that subject page and then write it down on that page. Listing each thought line after line. Don't worry about things being out of order. Just write down the first hand event that you experienced and witnessed, whenever a memory comes to you. You can rearrange them in order later.
Start writing down dates, times and places, the best that you can recall. Details are important. Start writing down how you felt at the time and how the children were feeling. Do it whenever you recall these traumatic events caused by the Cayuga nation tribal court.
